1. Eligibility and Lawful Use

By using our services, you represent that you are at least 18 years old or have reached the age of majority in your state of residence and have the authority to enter into these Terms.

You may not use our website or services:

For any unlawful, fraudulent, abusive, or unauthorized purpose

To violate any applicable federal, state, or local law

To interfere with the operation or security of our website or services

Specific services, deliverables, pricing, deadlines, placement details, distribution quantities, and payment terms may be described in a separate order form, invoice, proposal, written agreement, email, or other communication.

If a separate written agreement conflicts with these Terms, the separate written agreement will control with respect to the specific service covered by that agreement.

3. Advertising Placements

Advertising placements may be subject to availability, category exclusivity, publication deadlines, design requirements, and production schedules.

Unless expressly guaranteed in writing, Coastal 411 Media does not guarantee:

A specific number of inquiries, leads, sales, or customers

A particular financial return

Increased website traffic or social media engagement

Consumer response to an advertisement

That every recipient will view or retain a publication

That advertisements will produce results comparable to another advertiser or campaign

Advertising and marketing results vary based on factors outside our control, including the advertiser’s offer, reputation, pricing, market conditions, customer demand, competition, and follow-up process.

4. Advertiser Materials and Approvals

Advertisers may submit photographs, logos, trademarks, business names, copy, contact information, website addresses, social media information, and other materials for use in advertisements or publications.

By submitting materials, you represent and warrant that:

You own the materials or have permission to use them

The materials do not infringe upon another party’s rights

The information provided is accurate and not misleading

Any claims contained in the advertisement are lawful and supportable

You have obtained any necessary permissions, licenses, releases, or approvals

You grant Coastal 411 Media a nonexclusive, worldwide, royalty-free license to reproduce, resize, crop, edit, format, publish, print, distribute, display, and otherwise use the submitted materials as reasonably necessary to provide the requested services.

We may make reasonable formatting, grammatical, sizing, or design adjustments to submitted materials. Advertisers remain responsible for reviewing proofs and identifying errors before final approval.

Once an advertisement has been approved or the applicable approval deadline has passed, changes may not be possible.

5. Printing, Mailing, and Distribution

Print and mailing dates are estimates unless expressly guaranteed in writing.

Production or delivery may be affected by circumstances outside our reasonable control, including:

Printer delays

Postal-service delays

Weather

Transportation interruptions

Supply shortages

Technical problems

Incorrect information supplied by an advertiser

Government actions

Natural disasters or other force-majeure events

Minor variations in color, image placement, trimming, paper, print quality, mailing dates, or delivery are inherent in commercial printing and distribution and do not constitute a failure to provide the service.

Mailing quantities and routes may be based on postal records, carrier routes, household estimates, or third-party data and may change before distribution.

6. Fees and Payment

You agree to pay all fees associated with the services you purchase.

Unless otherwise stated in writing:

Payments are due according to the applicable invoice or order terms

Advertising placements are not reserved until any required payment is received

Production may be delayed if payment or required materials are not received by the deadline

You are responsible for applicable taxes, processing fees, or collection costs

Past-due amounts may result in suspension or cancellation of services

We may correct pricing errors before accepting or completing an order.

7. Cancellations and Refunds

Cancellation and refund eligibility may depend on the applicable service, production schedule, and expenses already incurred.

Unless otherwise agreed in writing, payments may become nonrefundable once Coastal 411 Media has:

Reserved an advertising placement

Begun design or production work

Submitted materials to a printer or distribution provider

Purchased postage, printing, media, or other third-party services

Rejected another advertiser based on category exclusivity

Passed the stated cancellation or production deadline

Any approved refund may be reduced by work completed, processing fees, third-party charges, or other nonrecoverable costs.

8. Sales Android SMS Messaging Program

Program Description

The Sales Android messaging program is operated by Coastal 411 Media.

After opting in, participants may receive text messages that demonstrate how a Sales Android could interact with prospective customers within the participant’s business.

Messages may include:

Simulated or representative customer interactions

Demonstrations of automated sales conversations

Information about how the Sales Android service works

Responses to inquiries initiated by the participant

Sales messages offering the Sales Android service

Follow-up messages sent as part of a sales sequence

The messages may use automated technology and may be sent from an automated messaging system.

Consent to Receive Messages

By providing your mobile telephone number and affirmatively opting in, you authorize Coastal 411 Media to send you informational, demonstration, promotional, and marketing text messages relating to the Sales Android program.

Consent to receive marketing text messages is not a condition of purchasing any product or service.

You represent that:

You are the subscriber or customary user of the telephone number provided

You are authorized to consent to receive messages at that number

The telephone number you provide is accurate

You will notify us if the number changes or is reassigned

Message Frequency

Message frequency may vary depending on your interaction with the program.

Participants may receive messages they request, responses generated during the Sales Android demonstration, and follow-up sales messages.

A typical introductory sales sequence may include up to two messages per day, with up to 10 messages in the sequence. Additional messages may be sent when you initiate or continue a conversation with us.

Message and Data Rates

Message and data rates may apply to messages sent to you and messages you send to us.

Your wireless carrier’s message, data, and other charges are governed by your agreement with your wireless provider. Contact your wireless provider with questions about your text-messaging or data plan.

Opting Out

You may cancel your participation in the SMS program at any time.

Reply STOP to any message to unsubscribe. You may also use another clear statement indicating that you no longer wish to receive messages.

After receiving your request, we may send one final text message confirming that you have been unsubscribed. After that confirmation, you will no longer receive marketing messages from the applicable program unless you opt in again.

To rejoin, complete the applicable sign-up or opt-in process again.

An opt-out request applies to the messaging program and telephone number associated with that request. Transactional or legally required messages may still be sent when permitted by law.

Carrier Disclaimer

Wireless carriers are not responsible for delayed or undelivered messages.

Message delivery is subject to effective transmission by your wireless provider and is not guaranteed.

Supported Devices and Carriers

Participation requires a text-message-capable mobile device and service through a participating wireless carrier.

The SMS program may not be available through every carrier or device, and we are not responsible for limitations imposed by your device, telephone service, carrier, or messaging application.

By voluntarily providing your contact information, you may receive communications concerning:

Local publications and advertising opportunities

Sales Android demonstrations

Requested information

Existing service arrangements

Promotional offers

Follow-up communications

You may unsubscribe from promotional emails by using the unsubscribe link included in the message or by contacting us.

We may continue to send necessary transactional, account, service, legal, or administrative communications.

10. Accuracy of Information

We make reasonable efforts to present accurate information, but we do not guarantee that all information on our website, in our publications, or in communications will always be complete, current, or error-free.

Advertisers retain ownership of their preexisting trademarks, logos, photographs, and other materials, subject to the license granted to us for providing the requested services.

13. Confidentiality

During a business relationship, either party may receive nonpublic business, customer, pricing, technical, or operational information.

Each party agrees to use reasonable care to protect confidential information and to use it only for purposes related to the applicable services.

Confidential information does not include information that:

Is publicly available through no breach of these Terms

Was lawfully known before disclosure

Is received lawfully from another source

Is independently developed without use of the confidential information

Must be disclosed under applicable law or legal process

To the fullest extent permitted by law, Coastal 411 Media’s total liability arising from a particular service will not exceed the amount you paid Coastal 411 Media for that particular service during the six months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

17. Indemnification

You agree to defend, indemnify, and hold harmless Coastal 411 Media and its owners, employees, contractors, agents, affiliates, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from:

Claims made in your advertisement

Your infringement of another party’s rights

Your violation of applicable law

Your misuse of our website or services

Your violation of these Terms

18. Termination

We may suspend or terminate access to our website, services, advertising programs, or messaging programs if:

These Terms are violated

Payment is not received when due

Information provided is false or misleading

Continued service may expose us or another party to legal or operational risk

A user engages in abusive, fraudulent, threatening, or unlawful conduct

Termination does not eliminate payment obligations or other provisions intended to survive termination.

19. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Subject to any applicable consumer-protection law, any legal proceeding relating to these Terms or our services must be brought in a state or federal court located in San Francisco County, California, and each party consents to the jurisdiction of those courts.
